Off-the-shelf Software

Setting aside various court judgments including the Karnataka High Court judgment, the Supreme Court has ruled that payments made by resident Indian end-users or distributors (such as technology companies) to the overseas supplier for reselling / redistribution of shrink-wrapped software could not be treated as ‘Royalty’ but could only be treated as business income in the hands of the overseas entity and no tax withholding obligations arose.
