As generative artificial intelligence (GenAI) becomes increasingly powerful and pervasive, the US Copyright Office has released an in-depth analysis on one of the most contentious topics in the intersection of technology and copyright: the use of copyrighted works in training AI models. The third part of its broader study on artificial intelligence released in May 2025, titled “Copyright and Artificial Intelligence, Part 3: Generative AI Training”, investigates the copyright implications of how generative models are developed and deployed, with a focus on legal questions surrounding infringement, fair use and licensing. The report is based on over 10,000 comments received in response to a Notice of Inquiry (NOI) published in August 2023.
