The London child \u201cintends to go to a court asserting — rightly or wrongly — that her privacy rights and those of others like her have been infringed in ways that call for a remedy,\u201d Judge Mark Warby said in a decision Wednesday. Not granting her anonymity could \u201chave a chilling effect on the bringing of claims by children to vindicate their data-protection rights.\u201d.<\/p>\n
TikTok has come under increased scrutiny by several EU data watchdogs over children\u2019s data. The EU\u2019s data-protection chiefs in June pledged to coordinate potential investigations into the Chinese company, establishing a taskforce to get a better understanding of \u201cTikTok\u2019s processing and practices.\u201d<\/p>\n
The planned suit is at a \u201cvery early stage,\u201d but the intended claim \u201cinvolves serious criticisms of what may be key aspects of the platform\u2019s mode of operation,\u201d Warby said. Given the popularity of ByteDance Ltd.\u2019s social media app, such a suit could lead to \u201cstrongly-worded\u201d opposition<\/p>\n
\u201cPrivacy and safety are top priorities for TikTok and we have robust policies, processes and technologies in place to protect all users, and our younger users in particular,\u201d the company said in a statement. \u201cAs this application was made without notice,\u201d TikTok became aware of the case earlier Wednesday and is now \u201cconsidering its implications.\u201d<\/p>\n
The Children\u2019s Commissioner for England, Anne Longfield, who would bring the case on behalf of the London girl, said the minor would risk \u201cdirect online bullying by other children or users of the TikTok app\u201d and \u201cnegative or hostile reactions from social media influencers,\u201d if her identity was known, according to the ruling.
