Apple moves Delhi High Court against CCI penalty rule based on global turnover

Multinational tech giant Apple Inc. has asked the Delhi High Court to restrain the government from enforcing the amended provisions of the Competition law, otherwise it could be fined $38 billion on the basis of its global turnover.

Under the amended Competition Act, the Competition Commission of India (CCI) can penalise a company up to 10% of its “global turnover derived from all the products and services” retrospectively. Earlier, the antitrust regulator could penalise only on the “relevant turnover” from the product or service under investigation derived from doing business in India.
