What is the ‘massive loophole’ in $100,000 H-1B fee that Indian lobbies in US are celebrating?

As the USCIS issued further clarification on who is exempt from the $100,000 H-1B visa fee, several Indian lobbies and immigration attorneys celebrated the ‘massive loophole’ that makes students on an F1 visa exempt from the fee. The USCIS clarified that individuals who are already in the United States and are seeking a change of status to an H-1B, extension of stay or amendment (a change in the employer) won’t require the fee.
